Sedona Lifts Weapons Restrictions Following Goldwater Letter

The Triumph of 2nd Amendment Rights in Sedona

A ground-breaking amendment was recently passed in the idyllic city of Sedona, Arizona. A place renowned for its parks, trails, and “open spaces,” but until now, forbidden by old legislature for law-abiding citizens to carry weapons for self-defense. Not anymore. Owing to the tireless efforts of the Goldwater Institute and local rights activists, Arizona’s firearm regulation have now expanded.

A Story of Activism: Goldwater Institute and AzCDL’s Victory

Understanding the challenges and implications of the previous legislation, the Goldwater Institute, in tandem with the Arizona Citizens Defense League (AzCDL) and other proponents, fought successfully to legalize carrying of firearms, knives, and non-projectile weapons for self-defense in Sedona. These are all protected by state law.

Crushing Unlawful Restriction: The Previous Ordinance

Prior to this glorious win for weapon rights, Sedona had an ordinance, City Code Section 12.30.090, enacted in 2006. This law made it broadly “unlawful to carry a deadly weapon into any park, trail, or open space area”. This comprised of firearms, knives with blades over three and a half inches, and other “items designed for lethal use.” Furthermore, the city required written authorization from the city for “[s]pecial events or instructional classes.”

Initiating Collaborative Actions: Challenging the Ordinance

Earlier this year, an AzCDL member, Gianluca Zanna, identified this provision and informed AzCDL of its likely contravention of Arizona’s firearm preemption statute. The city council was notified by AzCDL, along with Representative Quang Nguyen, Chair of the Judiciary Committee in the Arizona House of Representatives. From here began a legal fight to protect the fundamental rights of Sedona’s citizens. The council met in December and finally decided to roll back regulations.

Progressive Amendment, But A Long Road Ahead

With the removal of the sweeping prohibition on carrying weapons and all citations to knives, Sedona’s citizens can now legally bear arms, following all state and federal regulations. This progress exemplifies the power of informed citizens standing up for their rights. But the government is far from absolution in fully respecting these fundamental rights.

Remaining Hurdles in Full Implementation

The council left in place modified wording curtailing the possession of what the city categorizes as air or spring-powered projectile weaponry, confining them to parks, trails, and open spaces. This includes BB guns, pellet guns, crossbows, slingshots, among others. This incongruity lets a person legally carry rifles, shotguns, or handguns, but not a BB gun, crossbow, or slingshot even though all these weapons have lawful uses like target shooting, hunting, and self-defense.

Holding the Torch for Weapon Rights

Yes, there is celebration to be enjoyed with this legal victory that has asserted citizens’ rights to carry firearms and knives. But more can be done to fully protect these rights under state law and the constitution. It’s essential for organizations like Goldwater to continue the crusade for the fundamental right of self-defense in the U.S, not just in Arizona but across the country.

The Goldwater Institute is one such institution tirelessly defending gun rights and weapon-related businesses across America. In the coming years, they, among others, will continue to ensure American citizens enjoy the freedom to lawfully bear arms, to protect themselves and their families, and engage in activities such as hunting and target shooting as prescribed by law.

We hope more will be done to uphold the 2nd amendment rights to lawfully carry weapons including those omitted in the present amendment. All this, while we remain vigilant and keep a close watch on how the government respects, enforces and expand these laws.
